Russell Means <br />Environmental Protection Specialist <br />Division of Reclamation, Mining, & Safety <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Re: Moffat County, Smith Pit No 20 (Permit No. M-1978-085) (CHS # 54103) <br />Dear Mr. Means: <br />AM- 01 <br />RF-CEIVED <br />FEB 0 4 2009 <br />Division of Reciamation, <br />Mining and Safety <br />Thank you for your correspondence dated January 28, 2009 (received by our office on January 30, <br />2009) concerning the project listed above which is located on lands managed by the Bureau of Land <br />Management. <br />A search of our files indicates that at least four surveys have been conducted for cultural resources in <br />the vicinity of the proposed permit area. At least one cultural resource has been recorded in the permit <br />area that lacks an official determination of eligibility (5MF6531). Proposed mining activities should <br />avoid adverse effects to 5MF6531. If site avoidance is not possible, we recommend further <br />consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse <br />effect to the sites. <br />Since there is Federal agency involvement in this project, please note that it is the responsibility of <br />the Federal agency to meet the requirements of Section 106 of the National Historic Preservation <br />Act as set forth in 36 CFR 800 ("Protection of Historic Properties"). This includes the identification <br />of any historic properties (i.e. cultural resources which are eligible for or are listed in the NRHP) <br />within the area of potential effects and determining whether the undertaking will have an effect <br />upon such properties. The State Historic Preservation Office, Native American tribes, <br />representatives of local governments, and applicants for Federal permits, licenses or other approval <br />are entitled to consultative roles in this process. . <br />Thank you for the opportunity to comment.
