Proposed Decision
The Colorado Division of Reclamation, Mining and Safety proposes to approve an application for a permit
revision (PR-4). The revision application was submitted to the Division on July 9, 2007, and deemed
administratively complete on Julyl6, 2007. The application was submitted by Snowcap Coal Company, Inc., to
revise the postmine land use at the Roadside Unit Train Loadout, Railroad Spur and portions of the Overland
Conveyor. This decision is based on a fmding that the operation will comply with all requirements of the
Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et
seq., and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within
thirty (30) days of the first publication of the issuance of this proposed decision, then this decision becomes
final. The Division currently holds an adequate surety bond in the amount of $2,233,045.00. The permit
application and all supporting documentation will become a binding part of the permit. All previous
stipulations and conditions have been terminated or complied with and there are no new stipulations added
with Permit Revision No. 4.
Permit Revision No. 4 2 February 3, 2009
