III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of CDRMS. Dan Kipp and Don MacDonald of Coors Energy <br /> Company accompanied the inspection. Weld County Health Department inspector was on site conducting an inspection <br /> concurrently during the State inspection. The mine no longer extracts coal,but the remaining surface pit(Pit B)is permitted <br /> to dispose of flyash. CEC caps,regrades,topsoils and seeds the pit as the ash fill progresses. The mine site was cold(32°) <br /> with several inches of windblown snow throughout. Danny reported 0.07 inches of precipitation measured since January 1, <br /> 2009. Site was dry and breezy. <br /> Roads: The haul road to the pit and return to the facilities were dry with patches of wind blown snow. Roads and side <br /> ditches are well graded. The roads were not dusty and appear to be firm and frozen. Haul road are in good condition. <br /> Status of the mine access road was discussed. The ownership of the access road has been sold to private entities. <br /> Topsoil: The topsoil stockpile located south of A-1 on the access road continues to be bare of permanent vegetation. DRMS <br /> is evaluating if additional seeding would be necessary on this pile. <br /> Hydrologic Balance: Both the dugout pond and Pond 2 were dry and windblown. A small sheet of ice was in the bottom of <br /> Pond 2,however this ice was well below the embankment and below the staff gauge. Small drifts of snow were in both <br /> ponds as well. A small pool of ice was observed at the North end of Pit B. <br /> Backfill&Regrading: CEC continues to fill Pit B with ash. The operator has approximately one more pass of ash placement <br /> on the lower bench before they will start placing ash on the second bench. Current ash being placed is denser and the pit is <br /> receiving a lower volume than in late 2008. CEC continues to keep up on grading of ash. No blowing of ash or cover <br /> material was observed during the inspection. <br /> Wildlife: Several hawks were observed soaring throughout the mine site. CEC maintains raptor protection on the power <br /> poles. <br /> Support facilities: CEC has disconnected the gas tank at the fuel tank area,and plans to remove it from the mine site. Only 2 <br /> diesel tanks remain at the fuel station area. Office/warehouse area remains orderly. No additional construction of third party <br /> gas wells or ancillary oil&gas support facilities have been initiated. <br /> No problems were observed on site. <br /> Pane I of 4 Pinac Idntal 1/q4/gnnglinitinIQI ihh -- <br />
