Cattany <br />Division Director Colorado 81652 7 <br />/ Natural Resource Trustee <br />Re: Mamm Creek Pit, Permit M-2000-113, Reclamation Compliance Issues. <br />Dear Mr. and Mrs. Snyder, <br />The Division of Reclamation Mining and Safety (DRMS) has received your correspondence <br />regarding the reclamation of the Mamm Creek Gravel Pit operated by Lafarge West, Inc. From a <br />review of documents submitted by you it appears that there is a conflict between the Lafarge <br />(operator) and you (landowner) regarding issues within the lease as to timing of reclamation, etc. <br />Please be advised that DRMS does not get involved in civil matters or legal proceedings. <br />DRMS has contacted Lafarge West about the situation. The site is due for a regular monitoring <br />inspection in 2008. Due to weather and time of year staff is unable to inspect the site. The <br />inspection will be done this spring but an exact date cannot be given at this time. A normal <br />monitoring inspection does include a review of reclamation progress as outlined in the approved <br />permit. Please be aware that under the Act and Rules an operator has 5 years from the time it <br />notifies the Division a phase is completed to finish reclamation.
