Due to the delay in construction <br />activities associated with Climax 2010 Project, Climax hereby requests an extension for one <br />of the provisions attached to the approval of TR-14. Specifically, Climax requests a 90-day <br />extension for the submittal of the cost estimate for decommissioning and demolition of the <br />new mill and accessory buildings and for the new tailing delivery line. The extension will <br />allow time to document construction progress and deferment of various building aspects. <br />The second provision attached to TR-14 requires the submittal and approval of an <br />Emergency Response Plan (ERP). The ERP will be submitted prior to taking delivery of <br />designated chemicals which is not expected in the foreseeable future. <br />The Climax Molybdenum Company will continue to work with the Division of Reclamation, <br />Mining and Safety and appreciates its understanding in the downturn in the metals market. <br />Should you have any questions or require additional clarifications, please contact me at (719) <br />486-7563. <br />Sincerely, <br />4"'- <br />Gary A.
