PUBLIC NOTICE <br />New Elk Coal Company LLC, 1226 West First St, Trinidad, CO 81082, the operator of <br />the New Elk Mine, Permit number C-81-012, is filing for a technical revision to the New <br />Elk Permit with the State of Colorado, Division of Reclamation, Mining and Safety. For <br />filing purposes, this application was deemed complete by the Division on <br />2009. Permit C-81-012 renewal was approved by the Division on July 12, 2004. <br />The New Elk Mine is located approximately 7 miles west of Weston, Colorado on State <br />Hwy. 12, within Sections 13, 14, 21, 22, 23, 24, 25, 26, 27 and 28, TS33S, R68W. These <br />sections can be located on the USGS 7.5 minute Vigil and Weston quadrangle maps. A <br />total of 141 acres of surface disturbance from mining related activity is covered by a <br />Letter of Credit Bond in the amount of $2,744,969. <br />The technical revision restores the Apache Canyon airshafts and the underground <br />ventilation corridor connecting these airshafts to the New Elk Mine permit area. This <br />increases the permit area to 1,583 acres (an increase of 686 acres). <br />The technical revision is on file for public inspection at the Las Animas County <br />Courthouse, Office of County Recorder and with the Division of Minerals and Geology. <br />Any written comments, objections or requests for a public hearing or informal conference <br />regarding this bond release application must be submitted to the Division of Minerals and <br />Geology, 1313 Sherman Street, Room 215, Denver, Colorado 80203 within 10 days of <br />the date of the publication of this notice. <br />Date of Publication:
