Peak Project Management, LLC
34115 County Road 20.8 Trinidad, CO 81082
Telephone: (719) 846.4975 Fax: (719) 846.4930 Cell: (719) 859-0111
ronthompson@wildbiue.net
January 30, 2009
6? :00
9
WAS
Mr. Kent Gorham
Division of Reclamation, Mining & Safety v°v???r9 a
1313 Sherman Street, Room 215
Denver, CO 80203
Re: New Elk Mine Permit C-81-012
Dear Mr. Gorham:
Enclosed is an application for a technical revision to the New Elk Mine for an
incidental permit boundary change. This revision is requested to facilitate the safe
re-entry and exploration of the sealed mine workings at the New Elk mine.
Specifically, the re-opening of the Apache Canyon airshafts will allow the proper
ventilation of the New Elk underground mine openings. The new permit
boundary is shown on Map 3 Mine Plan
Both shafts were originally located within the New Elk Mine permit boundary and
were approved as part of the New Elk mine permit. They were transferred from
the New Elk permit to the Golden Eagle permit in 1998 and the Golden Eagle
permittee assumed the bonding and final reclamation liability. This action was
followed by a Phase III release for New Elk that reduced the permit acreage to 900
acres and excluded the shaft areas from the permit. Later a Phase III bond release
was granted to the Golden Eagle for the two airshafts. As part of this process,
Exhibit 25 of the New Elk permit detailing the airshaft construction was
transferred to the Golden Eagle permit.
This application updates a discussion of activities occurring at New Elk as the re-
entry process continues (pages 2.05-2 to 7) and restores Exhibit 25 to the New Elk
permit. Exhibit 25 details the construction of the South Apache shaft. The
northern most airshaft was a pre-law structure and little information concerning
this shaft is available. Exhibit 25 was previously submitted to the Division as part
of Permit Renewal 5 and later withdrawn. Please contact me if new copies are
needed.
