The Whirlwind Mine water <br />treatment plant is located at 30100 5110 Road, Gateway, Colorado 81522. Discharge of <br />treated water from the Whirlwind Mine is allowed in accordance with Colorado <br />Discharge Permit System (CDPS) permit number CO-0047562. In addition, this letter <br />serves as a written notification of non-compliance as required in Part II.A.4 of the permit. <br />On November 24, 2008 the Whirlwind Mine was put on stand-by status. At this time, the <br />mine will continue to be dewatered during stand-by and Energy Fuels will continue to <br />treat and discharge mine water and to comply with CDPS permit conditions. Mine water <br />collects in the mine at a slow rate (approximately 2 to 3 gpm) and is being pumped into <br />the untreated water tank and treated in batch runs, as necessary. Currently, batch runs are <br />occurring at a rate of approximately one run every month. One batch run occurred from <br />December 15 to 18, 2008. A monthly discharge sample was collected on December 16, <br />2008 in accordance with the aforementioned permit.
