The Division of Reclamation, Mining and Safety ("Division") received the application for
TR-51 (prepared by your office on behalf of Bowie Resources, LLC) on 22-Oct-2008. TR-51
is intended to fulfill the requirement of Stipulation No. 58, attached to the Division's July
2008 decision to approve TR-48 for the Bowie No. 1 Mine.
The Division determined the application to be Complete for purposes of filing on the 31St of
October 2008. Proof of the 05-Nov-2008 publication of the Notice was received by the
Division on 19-Nov-2008.
The proposed TR-51, which provides revised reclamation plan details for Cropland areas at
the Loadout Facility, has been reviewed for adequacy with respect to the Colorado Surface
Coal Mining Act and Regulations. Comments prepared by the Division are presented here for
your consideration.
1. Page 2.03-11 (Section 2.03.10) has been modified to show that four CDPHE Air
Pollution Control Division Emission Permits previously issued to the Loadout Facility
have been cancelled. Copies of the Initial Approval for each Emission Permit are
included in Exhibit 10 of Permit Volume 7.
Please submit copies of the APCD Cancellation letter for each of the four Emission
Permits to the Division for inclusion in Exhibit 10 of Permit Volume 7.
2. Page 2.05-26 has been modified to include the use of one or more brass impact
commercial size sprinkler systems for irrigation of substantial portions of the
reclaimed Loadout Facility. It is not clear, in the Permit, which water right(s) are
assigned to these parcels.
