Division Director <br />Nucla, Colorado 81424 Natural Resource Trustee <br />Re: New Horizon Mine, Permit No. C-81-008 <br />Technical Revision No. 55 (TR-55) Adequacy Review <br />Dear Mr. Gubka: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed <br />Western Fuels-Colorado (WFC's) TR-55 application submitted for proposed changes to <br />the revegetation plan. The Division has the following adequacy review comments. <br />1. The cover letter to the TR-55 application states that TR-55 solely covers the <br />change in success standards for irrigated pasture from a standard to a reference <br />area, with the exception of the inclusion of a proposal to include interseeding as a <br />husbandry practice for irrigated cropland. <br />Based on our review, there appear to be certain other changes included in the <br />application, including acreage of various postmining vegetation types, detail <br />regarding sampling protocol and statistical assessment for revegetation success <br />demonstration, and various other changes. However, it is clear that only a portion <br />of the concerns addressed in the Division's Technical Revision No. 54 (TR-54) <br />adequacy review letter dated November 21, 2006 were addressed in the TR-55 <br />submittal. Some of the concerns related to Vegetation Information, Premine and <br />Postmine Land Use, and the Revegetation Plan were addressed in TR-54 response <br />submittals, some are addressed in the current TR-55 application, and we are aware <br />that WFC is planning to submit a separate revision application (TR-56) to address <br />remaining issues. <br />In order to ensure and document that all issues identified in the November 21, <br />2006 adequacy letter (from TR-54) have been addressed, we have the following <br />request. Please include an introductory section with the TR-56 submittal, <br />providing an item by item response to each of the adequacy issues listed in <br />the November 21, 2006 adequacy letter (Items 1 through 28).
