STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
COLORADO
D IV IS I ON OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
INTERNAL MEMORANDUM Governor
Harris D. Sherman
Executive Director
Ronald W. Cattany
Division Director
DATE: December 7, 2007 Natural Resource Trustee
TO: Mike Boulay
FROM: Dan Mathews
RE: New Horizon Mine (Permit No. C-81-008)
Technical Revision No. 55 (TR-55)
I have reviewed the TR-55 application pursuant to your request, and my review comments are
listed here below. Please let me know if you have any questions.
1. The cover letter to the TR-55 application states that TR-55 solely covers the change in
success standards for irrigated pasture from a standard to a reference area, with the
exception of the inclusion of a proposal to include interseeding as a husbandry practice for
irrigated cropland.
Based on our review, there appear to be certain other changes included in the application,
including acreage of various postmining vegetation types, detail regarding sampling
protocol and statistical assessment for revegetation success demonstration, and various
other changes. However, it is clear that only a portion of the concerns addressed in the
Division's TR-54 adequacy review letter dated November 21, 2006 were addressed in the
TR-55 submittal. Some of the concerns related to Vegetation Information, Premine and
Postmine Land Use, and the Revegetation Plan were addressed in TR-54 response
submittals, some are addressed in the current TR-55 application, and we are aware that
WFC is planning to submit a separate revision application (TR-56) to address remaining
issues.
In order to ensure and document that all issues identified in the November 21, 2006
adequacy letter have been addressed, we have the following request. Please include an
introductory section with the TR-56 submittal, providing an item by item response to
each of the adequacy issues listed in the November 21, 2006 adequacy letter (Items 1
through 28). Within the response, identify items that were addressed and approved
within TR-54 (if any), as well as items that were addressed within the TR-55
submittal, and Items addressed within the TR-56 submittal. Include reference to
associated text, tables, maps, or appendices, along with the applicable page or map
revision date. If a particular page or exhibit was amended more than once, please
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
