Cattany Division Director Natural Resource Trustee The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on November 20, 2007, an application to revise coal mining operations at the New Horizon Mine was considered complete for the purposes of filing. The revision was submitted by Western Fuels-Colorado, LLC. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. This technical revision proposes changes to the revegetation plan, including a revision to the current success standard for irrigated pasture, to base the standard on reference area comparison rather than a technical standard. The operator has requested no new disturbed acreage with this revision application, nor would additional lands be incorporated into the permit area. The Surface coal mining operation is on land located approximately 1 mile north of Nucla, Colorado. The permit area is further described as follows: Portions of Sections 1 and 6, Township 46 North, Range 15 West, New Mexico Prime Meridian; and Portions of Sections 25, 31, and 36, Township 47 North, Range 16 West, New Mexico Prime Meridian The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla. The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of publication of this notice, the applicant is additionally required to place a copy of this application at the Montrose County Clerk and Recorder, 161 South Townsend, Montrose, CO 81401, and at the Division office.
