Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 116, Paragraph 4, of the Colorado Revised Statutes, that on November 20, 2007, an application to revise <br />coal mining operations at the New Horizon Mine was considered complete for the purposes of filing. The revision <br />was submitted by Western Fuels-Colorado, LLC. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This technical revision proposes changes to the revegetation plan, including a revision to the current success <br />standard for irrigated pasture, to base the standard on reference area comparison rather than a technical standard. <br />The operator has requested no new disturbed acreage with this revision application, nor would additional lands be <br />incorporated into the permit area. <br />The Surface coal mining operation is on land located approximately 1 mile north of Nucla, Colorado. The permit <br />area is further described as follows: <br />Portions of Sections 1 and 6, Township 46 North, Range 15 West, New Mexico Prime Meridian; and <br />Portions of Sections 25, 31, and 36, Township 47 North, Range 16 West, New Mexico Prime Meridian <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Nucla. <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete. <br />At the time of publication of this notice, the applicant is additionally required to place a copy of this application at <br />the Montrose County Clerk and Recorder, 161 South Townsend, Montrose, CO 81401, and at the Division office. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines
