The stock tank delineations at a minimum <br />include a few upland catchments that most likely are not COE jurisdictional. It is possible that several <br />additional delineations within the various stream reaches (those lacking wetland vegetation and wetland <br />indicator soils) are not jurisdictional as well, however, this determination cannot be made by Cedar Creek. <br />A significant number of delineated stock tanks however, do exhibit sufficient wetland characteristics that <br />jurisdiction by the COE is probable. The one (and largest) component of development that is known, and is largely fixed (i.e. <br />cannot be moved to avoid wetlands) is the footprint of the eventual pit. Within this area only 0.27 acres of <br />wetlands, 0.17 acres of WUS, and 1.37 acres of stock tanks (with unknown jurisdiction) were found and <br />delineated (see Table 2). These total to 1.81 acres or 3% of the delineated wetlands from within study <br />area boundaries. In contrast, the pit will disturb approximately 20% of study area acreage. The individual <br />acreages for these disturbance area features are presented on Tables 6, 7, and 8. <br />A summary of the vegetation, soils, and hydrology information from each primary sample point, <br />especially the 6 larger wetlands (Points 1 - 6), is presented on Table 9. The acreages of these six larger <br />wetlands in order from 1 to 6 is 0.571, 1.912, 6.214, 5.456, 4.897, and 0.782 acres, respectively. The <br />remaining three sample points (7, 8, and 9) were placed and sampled to be representative of three <br />primary factors: elevation, relative size of streamside wetland, and watershed. Point No. 7 is lowest in <br />elevation, on Wilson Creek, and representative of a larger streamside wetland.
