RULE 2 PERMITS Blunt, Environmental Engineer. Colowyo's Employer Identification Number is 87-0522903. Colowyo's MSHA number is 05-02962. The current officers and directors of each of Colowyo Coal Company L.P., Kennecott Colorado Coal Company, and Rio Tinto Energy America Inc. are included in Exhibit 2, Volume 2A. Surface and Mineral Ownership The surface and coal ownership in the Collom permit expansion area and adjacent areas is shown on Map 1 and Map 2 and is presented in Volume 2A Exhibit 1, Documents and Leases. The legal or equitable owners of record of the property to be mined or affected by surface operations and facilities incidental thereto within the Collom permit expansion area are: Colowvo Coal Company L.P., 5731 State Hi hway 13, Meeker CO 81641 State of Colorado, 1313 Sherman Street, Room 620, Denver CO 80203 U.S. Bureau of Land Management, 455 Emerson Street Craig CO 81625 Within the Colowyo revised permit boundary, Colowyo is the holder of Federal Coal Lease Nos. D- 034365, C-35874, C-29224, C-29225, C-29226, C-0123475, C-0123476, COC 68590. Unleased federal coal lease for Little Collom X pit area is pending. Colowyo is the holder of State of Colorado Coal Lease 257-13S. The owners of the coal rights are shown on Map 2 and are listed in Exhibit 1, Volume 2A of the existing permit document. Owners of land contiguous to the permit boundary are shown on Map 1 and are listed in Exhibit 1 of the existing permit document. Colowyo owns various interests in land contiguous to the Collom permit expansion area and the existing permit area. These lands are operated as agricultural properties and contain no areas where mining has occurred since 1977. Colowyo is the only holder of record of any leasehold interest in the Collom permit expansion area to be mined or to be affected by surface operations and facilities incidental thereto. Any purchase of record under a real estate contract of the Collom permit expansion area to be mined is the same as the applicant, Colowyo. There are no other holders of record of any leasehold interests for areas located within the Collom permit expansion area. Colowyo Coal Company L.P. will remit all required abandoned mine land reclamation fees. There is no pending purchaser of record of any surface or mineral estate under a real estate contract for areas located within the permit boundary. The information required under Rule 2.03.4 regarding surface coal mining permit information through "ownership and control" relationship is provided in Exhibit 2, Volume 2A. Information regarding the Colowyo existing permit area and contiguous surface and subsurface ownership may be found in Exhibit 1, Item 11, Volume 2A.
