III. COMMENTS -COMPLIANCE

Photograph No. 6 is from the top of the North Decline Road looking to the west. Mr. Fontanari stated
that he believes the linear snow filled feature seen in the center of the photograph is an old subsidence
crack that occurred while mining was active beneath this location approximately 10-12 years ago.
Photograph No. 7 was taken from the hilltop above the bend in the road where the small amount of
water discharges from the rock outcrop (previously described above). Photo No. 7 is the location of
the buried 4 foot diameter Ute Water line.
This inspection report serves to document the features that Mr. Fontanari has identified on his property
within the mine permit boundary that he believes to be potentially caused by subsidence from the
Roadside Portals Mine.
