III. COMMENTS - COMPLIANCE <br /> Below are comments on the Inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety on January 21, 2009. I was not accompanied by an operator <br /> representative during the inspection. Weather conditions were clear and cold. Ground conditions were <br /> mostly snow covered. Coal was being loaded and hauled at the time of the inspection. <br /> Sims and Markers <br /> The AVS annual compliance inspection was done during this inspection. The PermitteeJOperator and <br /> MSHA ID were consistent for all of the following: Mine ID Sign, direct inquiry of person on site <br /> (Gary Isaac Mine Manager)and the permit application. A copy of the AVS compliance worksheet is <br /> attached. <br /> Roads <br /> Roads were well maintained and in good condition throughout the site. Ditches were snow packed and <br /> frozen. The Haul Road was dry at the lower portion of the mine but damp and muddy around the <br /> portal areas. <br /> Hydrologic Balance <br /> East Salt Creek was mostly frozen but did have a small amount of flow at the bridge/entrance to the <br /> mine. There was a significant amount of snow at the site: all areas surrounding the mine were snow <br /> packed. Drainage structures and diversion culverts in the portal area were mostly snow covered. As <br /> seen in the attached photo the surface of the sediment pond was frozen at a level a few feet below the <br /> principal spillway. The pond was maintained and functional and no problems were noted at any of the <br /> mine site locations during this inspection. <br /> a <br />
