Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve <br />Bond Release Application No. 2 (SL-2) for the Seneca II Mine, Permit No. C-1980-005. The mine is <br />operated by Seneca Coal Company under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by Seneca Coal Company on June <br />28, 2007. Seneca Coal Company is requesting final bond release on 259.1 reclaimed acres of Pre-Law <br />lands located within the permit boundary at the Seneca 11 Mine. The full liability bond release request <br />is for a portion of the 326.5 acres of total Pre-Law area at the Seneca II Mine. Seneca Coal Company <br />did not include 67.4 acres of Pre-Law area associated with the Old Wolf Creek Pit in this bond release <br />application. Of the 259.1 acres requested, the Division of Reclamation, Mining, and Safety is <br />proposing to release 257.71 acres from full bond liability. The Division will not be releasing 1.39 acres <br />for the lower end of PL-1 Channel and a small Dozer Track that was used to access the upper Wolf <br />Creek Pit. The 1.39 acres not released will be included with the 67.4 acres of the Old Wolf Creek Pit <br />Area to give a total of 68.79 acres of Pre-Law lands remaining at the Seneca II Mine with regard to <br />future bond releases. Surety bonds in the amount of $7,183,489.00 are currently in place of which <br />$871,645.00 is being released. The affected area is located in Routt County, approximately 9 miles <br />Southeast of Hayden, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Hayden Public Library. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
