Stark <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RECEIVED <br />JAN 2 0 ZOOS <br />Division <br />Mining arC 8F'1* <br />RE: Notice of Completion of Abatement Condition #1 of NOV CV - 2008 -04, Colowyo Coal Co. <br />L.P., Permit No. C- 1981 -019. <br />Dear Mr. Stark, <br />The purpose of this letter is to inform the Division of Colowyo's completion of Abatement Condition <br />Number One, Clean the Prospect Pond to remove the sediment to restore the proper pond volume <br />and function, put forth by the Division as a result of NOV CV- 2008 -004. Colowyo awarded the bid to <br />Anson Excavating and Pipe, LLC. (Anson) on 13 October 2008 who began building a dredge pad in <br />the middle of the pond on 24 November 2008. Commencement of the actual Prospect Pond dredging <br />took place on 1 December 2008. <br />Exceptional climatic and ground conditions enabled Anson to remove an average of 400 cubic yards <br />per day over 18 working days, completing the project on 22 January 2009, and well in advance of <br />Colowyo's previous prediction for finishing the project.
