A4atcrials Containment Plan (continued) <br />Nothing herein contained shall be construed az allowing any discharge to waters of the Slate other than through the <br />discharge points specifically authorized in this permit. Nothing herein contained shall be constmed as excusing any <br />liability the permittce might have, civil or criminal, for any spill. <br />The submittal o(a Spill Prevention Comrol and Countcrmcasure Plan (SPCC Plan) az required by 40 CFR Pan 112 may <br />satisfy all or part of this requirement. Should additional materials exist on site which are not addressed in the SPCC <br />Plan, addressing those materials as per the above is required. <br />I/ If there is nu such matenat prcscm at the Sim, this shall be indica¢d in writing anJ submiueJ to the Division for review. <br />2/ If there is material present but die perminee feels there is not a reasonable probability of a spill impacting waters of the $Iale, this shall be documented in <br />writing anJ submined to the Division for review. 'this documenution shall include; 1) distance to nearest surface waters. and; 2) a detailed description of <br />any sweNre which prohibits the release of material omo th< ground or into a conveyance system. <br />2. Stormwater Requirements <br />(a) General Limitations <br />I) Stormwater u•Itich mixes with process water or ntinc drainage is subject to effluent limitation guidelines. <br />2) Stormwater discharges from active or inactive mining operations activities shall not cause or threaten to cause <br />pollution, contamination or degradation of Slate waters. <br />• 3) Bulk storage stmctures for petroleum products and other chemicals shall have adequate protection so az to <br />contain all spills and prevent any spilled material from emering State waters. <br />(b) Stormwater D1anaecmcnt Plan -Contents and Requirements <br />A current Stormtr•ater Management Plan (SWMP) shall be maintained for the portions of the Bear Mine No. 3 that <br />are covered by this section of the permit. The S1VMP shall include the following items, a[ a minimum: <br />1) Description o(MininQ Activities. The plan shall provide a narrative description o(tite mining and associated <br />activities taking place at the Bear Mine No. 3, or having taken place in the pazt, which affect or may affect <br />Stormwater moot( intended to be covered by this permit. The narrative description shall report the total acreage <br />within the mint site and an estimate of the number o(acres of disturbed area. - <br />2) Area Subicct to Effluent Limitations Guidelines. Tht: SWMP shall describe the portions of the site which <br />contribute moo(( to areas subject to effluent limitations guidelines contained in 40 CFR subchapter N. <br />3) Site Man. The plan shall provide a site map or maps which indicate the following information, at a minimum. <br />For the entire area: <br />- mining/milling site boundaries and access and haul roads; <br />- equipment storage, fueling and maintenance areaz; <br />- materials handling areas; <br />- areas used for storage of overburden, materials, soils or wastes; <br />- areas used for outdoor manufacturing, storage or disposal of materials; <br />- location o(mine drainage or any other process water; <br />- tailings piles/ponds, both new and pre-existing; <br />- mine drainage or any other process water discharge points; <br />• _ springs, streams, we[lands and other surface waters; and <br />boundaries of areas that contribute mnoCf to outfalls that are subject to effluent limitations guidelines. <br />1NDBP November 11, 19A1 <br />
