PART II <br />Page No. 13 <br />Permit No. COG-850000 <br />5. Toxicity Reopener <br />This permit may be reopened and modified (following proper administrative procedures) to include new <br />compliance dates, additional or modified numerical permit limitations, a new or different compliance schedule, a <br />change in the whole effluent toxicity testing protocol, or any other conditions related to the control of toxicants if <br />one or more of the following events occur: <br />i. Toxicity has been demonstrated in the effluent and the permit does not contain a toxicity limitation. <br />ii. The PTI/TIE results indicate that the identified toxicant(s) represent pollutant(s) that maybe controlled with <br />specific numerical limits and the permit issuing authority agrees that the control of such toxicants through <br />numerical limits is the most appropriate course of action. <br />iii. The PTI/TIE reveals other unique conditions or characteristics, which, in the opinion of the permit issuing <br />authority, justify the incorporation ofunanticipated special conditions in the permit. <br />C. STORMWATER REQUIREMENTS <br />1. Stormwater Management Plan (SWMP) <br />A Stormwater Management Plan (SWMP) shall be developed for the portion of each facility covered by this section of the <br />permit. The SWMP shall be prepared in accordance with good engineering practices. (A registered engineer need not complete <br />the plan.) <br />The plan shall identify potential sources of pollution (including sediment), which may reasonably be expected to affect the <br />quality of stormwater discharges associated with the mining operation. In addition, the plan shall describe and ensure the <br />implementation of best management practices (BMPs), which will be used to reduce the pollutants in stormwater discharges, <br />associated with mining activity. <br />Mining operations must implement the provisions of the SWMP required under this part as a condition of this permit. The <br />Division reserves the right to request and review the plans, and to require additional measures to prevent and control pollution, <br />as needed. <br />The SWMP shall describe all areas that have not been previously permitted, and which meet the defmition of a stormwater <br />discharge in 40 CFR 122.26. Examples of such areas are roads and raihoad lines used for transportation to and from the site, <br />outslopes ofponds, inactive loadouts, sites used for storage and maintenance of material handling equipment, and areas granted <br />small area exemptions. <br />a. SWMP Contents <br />The SWMP shall include the following items, at a minimum: <br />1. Site Map <br />The plan shall provide a site map or maps, which indicate, at a minimum: <br />- Mining site boundaries <br />- Access and haul roads <br />- Equipment storage, fueling and maintenance areas <br />- Areas used for outdoor manufacturing <br />- Stormwater outfalls and an outline of the drainage area of each stormwater outfall <br />- An estimate of the direction of flow <br />- Materials handling areas <br />- Each existing structural control measure to reduce pollutants in stormwater runoff <br />- Areas used for storage or disposal of overburden, materials, soils or wastes, including tailings piles or ponds <br />- Areas used for mineral milling and processing <br />- Springs, streams, wetlands and other surface waters <br />Location of mine drainage or any other process water discharge points <br />- boundary of area that contributes runoff to outfalls that are subject to effluent limitations guidelines. <br />- Date the map was prepared <br />
