CHAPTER 5 <br />RESPONSE TO COMMENTS ON THE DRAFT EIS <br />• <br />• <br />This chapter contains responses to the <br />comments received on the Draft EIS. The <br />DEIS was sent to the mailing list found in <br />Chapter 4 of the DEIS in March 2007. A <br />notice of availability appeared in the Federal <br />Register (Vol.. 72,. No. 56, pg.13786) on <br />March 23, 2007, initiating the public comment <br />period. The comment period closed on May 7, <br />2005. <br />Table 5-1 <br />DEIS Comments and Responses <br />Commenter Comment Comment/Response <br /> <br />Mountain Coal 1-12, 14-28 Minor editorial/grammatical changes. <br />Company RESPONSE: Appropriate changes have been made to the FEIS. <br />Mountain Coal 13 Clarification. Do ATV trails, upgraded to project roads, need to meet criterion <br />Company 7 on page 22? <br /> RESPONSE: To clarify, to use the term trail implies that the feature on the <br /> ground is managed by the FS. The situation on the ground in the project area <br /> is that there are user-created ATV routes that are not facilities managed by the <br /> FS. <br /> The Proposed Action includes constructing temporary roads on the locations <br /> where existing user-created ATV routes exist. These will be project roads that <br /> will NOT be open to the public (Table 2-1, Design Criteria NR states that new <br /> project access roads will be gated and closed to the public year long). Further, <br /> under FS policy, these temporary roads are considered `Leve12 resource <br /> extraction roads'. FS policy further guides that the AASHTO Engineering <br /> Standards for Low Volume Roads applies only to roads that are open to the <br /> public (for this project the AASHTO standards will apply to any construction <br /> on existing National Forest System Roads (NFSRs) that are open to the <br /> public. These segments are listed in the FEIS, Table 3-13). <br /> Therefore, the temporary road construction for the project will not fall under <br /> the AASHTO Standards, rather they will be designed and constructed <br /> according to the criteria and BMPs from the Forest Service Manual.
