Box 591 Somerset Colorado 81434 Phone: 970-929-5015 <br />(hereafter called the permittee) is hereby granted use of the following road(s) or road segments: <br />Forest Road No. 710 (Minnesota Creek Rd) From Forest Boundary to Lick Creek = 2.0 miles <br />Forest Road No. 711 (Dry Fork of Minnesota Creek Rd) From FR # 710 to FR # 711.3B = 5.5 Holes <br />Forest Road No. 711. lA (West Flatiron Rd) From FR # 711.2B to FR# 711.A2(Long Draw Saddle Rd) 2.2 Holes <br />Forest Road No. 711.2A (Deer Creek Rdl From FR # 711 South 1.0 mile <br />Forest Road No. 711.2B~Horse Gulch Rd) From FR # 711 to FR #7 11.1A = 0.6 nines <br />Forest Road No. 711.A2A (Upper Sylvester Gulch Rd) from FR# 711A2 to ternunus = 1.0 miles <br />Forest Road No. 711.A2 (Long Draw Saddle Rd) Froin FR # 711 to FR # 711. lA = 2.0 miles <br />Forest Road No. 711.B 1 (Sylvester Gulch Rd) From Forest Boundary to FR# 711. lA = 1.0 miles <br />And other roads within the lease area as approved by the Paonia Dishict Ramer <br />Total miles of Forest Road use authorized by this permit =15.3 miles on the Gutuuson National Forest, subject to the provisions of <br />this permit including clauses 1 through 20, on page(s) 1 tlu•ough 7 for the purpose of drilling and maintaining Methane drainage <br />wells, exploration drilling, and subsequent reclamation activities. <br />The exercise of any of the privileges granted in this permit constitutes acceptance of all the conditions of the permit. <br />1. INVESTMENT SHARING RATES. The rate for sharing under this permit is N/A. <br />Z-1. WORK REQUIRED TO ACCOMMODATE PERMITTED USE. In accordance with this use, the permittee shall perform the <br />work described below and in accordance with plans and specifications attached hereto: <br />i permittee is required to perform all Consriuction, Reconshuction, Maintenance, and Reclamation work related to improvements in <br />accordance with the approved Annual Operating Plan (AOP). Maintenance requirements are detailed on the supplemental pages <br />attached to this permit. Conshuction and Reconstruction will be preformed under plans and specifications approved, in writing, by <br />the Paonia District Ranger. <br />WORK PERFORMANCE SCHEDULE: Work shall be performed in accordance with the AOP. Worl< not outlined in the AOP <br />will be approved by the Paonia District Ranger, in writing, prior to conunencement and completed prior to October 1~' of each year. <br />The Paonia District Ranger must approve any changes or additions to the AOP before said use ma~~ commence. . <br />2-2. COOPERATIVE WORK. Although not required to accomm~odate the use herein pernvtted, it is desirable tii the 1sorest tiers iee <br />and the permittee to have certain construction or reconsriuction work accomplished coincident to use of the road. I~he permittee shall <br />perform the work described below in accordance with plans and specifications attached hereto. <br />Any cooperative work will be included in the AOP or approved, in writing, by the Paonia Dishict Ranger after agreement between <br />the U.S. Forest Service and'Mountain Coal Company. <br />2-3. CASH DEPOSITS REQUIRED IN LIEU OF WORK PERFORMANCE. The permttee will deposit $N/A with the Forest <br />Service on or before N/A. The amount deposited will be credited to the share to be borne by the pernuttee. <br />2-4. COST RECOVERY.
