Rule 2.0.5.5 - Postminine Land Uses
(1) Surface Coal Minin>? Activities
{a) Each plan shall contain a detailed narrative of the proposed use, followine reclamation of
the land within the proposed permit area. In accordance widtland use categories established in the narrative, the
plan shall include a discussion of the utility and capaciri~ of the reclaimed land to support a varicri of alternative
uses, and the relationship of the nroposed use to existing land use policies and plans. This description shall explain.
(i) How the proposed posunining land use is to be achieved and the necessary support
activities which may be needed to achieve the nroposed land use;
(ii) Where a land use different from the nremining land use is prouosed, all materials
needed for approval of the alternative use under 4.16;
(iii) The consideration which has been given to making all of the prouosed surface coal
mining and reclamation operations consistent with surface owner plans and programs; and
(b) The description shall be accompanied by a cow of the comments concerning the proposed
use by the legal or equitable owncr of record of the surface of the proposed permit area and the State and local
government agencies which would have [o initiate, implement, approve. or authorize the proposed use of the land
followine reclamation.
(c) A map prepared [o the standards of 2.10 shall accompany [he plan.
• RESPONSE
TCC is requesting approval for an underground mine with this permit revision application. Therefore, the
requirements of this Section are not applicable to the Foidel Creek operation. Details regarding postmining land
uses at the Fish Creek Tipple, which is a surface operation, are enumerated within the Fish Creek Tipple Appendix,
Volume VII, Rule 2.05.5(1).
{2) Underground Mining Activities
a) Each plan shall contain a detailed narrative of the proposed use, followine reclamation of
the land to be affected by all surface operations and facilities within the proposed permit area. In accordance with
the land use categories established in the narrative, the plan shall include a discussion of the utility and capacity of
the reclaimed land to support a variety of uses and the relationship of the prouosed use to existing land use oolicies
and plans. The description shall explain
(i) How the proposed posunining land use is to be achieved and [hc necessary support
activities which may be needed to achieve the proposed land use:
(ii) Where a land use different t}om the premising land use Is proposed, all materials
needed for approval of the alternative use under 4.16: and
(iii) The consideration which has been ~icen to making all of the nroposed surface
