Box 456 <br />Montrose, CO. 81401 <br />Subject: B1ueRock Energy Resources, J-Bird Mine; Permit # M-2005-0P; Stormwater <br />Management Plan, Retention Basin(s), 72-Hour Release Requirement. <br />Dear Mr. Hurford, <br />On behalf of BlueRock Energy Corp (BREC), Gault Group Inc., requests clarification for the record <br />regarding releasing of site specific contact stormwater in retention basins by 72-hours. This specific <br />site resides in Montrose County, 5 miles South West of Paradox, CO. The legal description of <br />Principal Meridian 10t1i New Mexico, Township 47 North, Range 20 East, Section 13. This site has an <br />active permit to operate an Underground Uranium Mine with the Colorado Division of Reclamation <br />Mining and Safety, # M-2005-050. The site is less than 10 acres and the retention basins are less than <br />0.2 acres of the total. A stormwater management plan is in place and a Certification to Discharge # <br />COR-040235 with the Colorado Department of Public Health and Environment Water Quality Control <br />Division has been issued. There are no perennial waters in area of operations. Ephemeral drainages <br />flow only during monsoon season and peak spring snow-melt. All off-site surface water and sediments <br />are controlled by diversion structures. The minimal amount of seasonally retained meteoric water will <br />return to the natural water cycle through percolation, infiltration and evaporation. Retention basins <br />will be lined with minimal 18" of natural Wrayha soils to filter and settle on-site sediments. <br />As per our Friday, January 10th, 2009 phone conversation, please develop official documentation to <br />DRMS, BREC and GGI. This site is not required to release on-site retained meteoric water with-in 72 <br />hours.
