Box 591 <br />Somerset, Colorado 81434 <br />Dear Mr. DiClaudio: <br />On January 15, 2009, the U.S. Department of the Interior approved a mining plan modification <br />for Federal leases C-1362 and COC-67232 at Mountain Coal Company, L.L.C.'s West Elk Mine. <br />This mining plan action relates to Federal lands associated with the Colorado Division of <br />Reclamation, Mining and Safety's Proposed Decision and Findings of Compliance for West Elk <br />Mine (Permit No. C-1980-007) Proposed Decision - Permit Revision No. 14 (PR-14) Methane <br />Drainage Wells for Longwall Panels E2 Through E12 approved on October 10, 2008. <br />I have enclosed a copy of the mining plan approval document and associated map for this mining <br />plan modification. Please read the terms and conditions of the mining plan approval document <br />carefully. Mining and reclamation operations must be conducted in accordance with both the <br />Colorado state permit and the approved mining plan. <br />The January 15, 2009, approval allows you to initiate construction activities associated with <br />Permit Revision No. 14 on Federal leases C-1362 and COC-67232 within the area of mining plan <br />approval.
