• 11. The Proposed Action <br />Specifically, the mining plan action proposed by Mountain Coal Company, L.L.C. <br />consists of the installation of up to 137 wells on 116 well pads, the construction of 8.52 <br />miles of roads, disturbing 47.5 acres over the next 12 years on Federal leases C-1362 and <br />COC-67232 within the area covered by Colorado State permit C-1980-007, in portions <br />of: <br />Township 13 South, Range 90 West 6th P.M. <br />Sections: 29, 32, 33, 34, 35, portions thereof. <br />Township 14 South, Range 90 West 6th P.M. <br />Sections: 1, 2, 3, 4, 9, 10 and 11, portions thereof. <br />The projected life of the mining operations is not expected to change under Colorado <br />Permit C-1980-007 and this proposed mining plan modification. However without the <br />approval of this mining plan modification the build up of methane in the mine's <br />atmosphere would result in immediate closure of the mine by the Mine Safety and Health <br />Administration for health and safety reasons. <br />The average annual production rate and the maximum production rate would not change. <br />• The approved State permit area would not increase from its present 17,154.90 acres. <br />Surface disturbance within the approved State permit area will increase by eighty (80.0) <br />acres from its present 422.45 acres to a new total of 502.45 acres. <br />This mining plan modification will not add any additional Federal surface acres or <br />Federal coal to the approved mining plan area shown on the map included with this <br />decision document. <br />The post mining land use within the permit and mining plan area would not change. <br />IV. Review Process <br />The CO-DRMS reviewed the PAP under the Colorado State program, the Federal lands <br />program (30 CFR Chapter VII, Subchapter D), and the Colorado cooperative agreement <br />(30 CFR § 906.30). Pursuant to the Colorado State program and the cooperative <br />agreement, CO-DRMS proposed approval of the permit revision on October 10, 2008. <br />OSM has consulted with other Federal agencies for compliance with the requirements of <br />applicable Federal laws. Their comments and/or concurrences are included in this <br />decision document. <br />•
