CHRONOLOGY <br />• West Elk Mine <br />Federal Leases C-1362 and COC-67232 <br />Mining Plan Decision Document <br />DATE EVENT <br />July 24, 20071 The State Historic Preservation Office was notified that no sites <br />were identified as potentially eligible for the National Register of <br />Historic Places and that the Deer Creek Shaft and E Seam Methane <br />Drainage Wells Project has no potential to effect cultural resources. <br />August 2, 20071 The U.S. Fish and Wildlife Service provided its final consultation <br />comments regarding threatened and endangered species associated <br />with the Deer Creek Shaft and E Seam Methane Drainage Wells <br />Project. <br />November 8, 20072 The Federal land management agency, USDA Forest Service, <br />Forest Supervisor issued the Record of Decision for the E Seam <br />Methane Drainage Wells Project. <br />December 31, 20072 Earthjustice et. al. appealed the Record of Decision to the USDA <br />• Deputy Regional Forester. <br />February 13, 20082 The USDA Deputy Regional Forester reversed the Record of <br /> Decision and remanded it back to the Forest Supervisor. <br />March 7, 20082 The USDA Forest Supervisor issued a second Record of Decision <br /> for the E Seam Methane Drainage Wells Project. <br />April 28, 20082 Earthjustice er al. appealed the second Record of Decision to the <br /> USDA Deputy Regional Forester. <br />June 2, 20082 The USDA Deputy Regional Forester affirmed the second Record <br /> of the Forest Supervisor. <br />' These consultations were completed for the Deer Creek Shaft approved by Colorado Division of Reclamation, <br />Mining and Safety on July 24, 2007, and covered the area associated with this permit revision. The associated <br />mining plan modification was approved by the Assistant Secretary Land and Minerals Management on October 31, <br />2007. <br />2 This Record of Decision and appeals were completed for the E Seam Methane Drainage Wells for Longwall Panel <br />E 1 approved by Colorado Division of Reclamation, Mining and Safety on June 9, 2008, and covered the area <br />associated with this permit revision. The associated mining plan modification was approved by the Assistant <br />• Secretary Land and Minerals Management on July 31, 2008.
