III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection or records check. Snow,that was about two feet deep, covered the entire <br /> reclaimed mine site. <br /> Roads <br /> The public road up Hubbard Creek canyon was well maintained and passable.The mine access road over <br /> Hubbard Creek was plowed up to the main gate,which was closed and locked,while the light use road leading <br /> to reclaimed pond 5 was covered in snow. <br /> Signs and Markers <br /> The mine ID sign was up on the front gate.The sign contained the required mine identification information. The <br /> "records location" sign was also attached to the front gate. Surface disturbance markers were up around the <br /> disturbed area. <br /> Hydrolo�y <br /> All of the sediment control structures were covered in deep snow, except for the Hubbard Creek culvert, which <br /> was clear of any debris. <br /> Reclamation <br /> Reclaimed ponds 4 and 5 were covered in snow.The operator had installed silt fence on the downstream end of <br /> each reclaimed pond. Only the top of the silt fence was sticking up out of the snow. Several sections of the black <br /> culvert,removed from the north side drainage, are still sitting on the reclaimed coal stockpile area and will need <br /> to be removed. <br /> The reclaimed mine benches and outslopes were completely covered in snow,as was the reclaimed coal <br /> stockpile area.There was no evidence of any slope instability. <br /> Records <br /> The required public records were located in the Delta County Clerk and Recorders Office, as documented on the <br /> attached records checklist. <br /> c:/word/blueribbon/insp0109 <br />
