III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection.Bill Bear represented the Bear Coal Company during the records check. <br /> The reclaimed mine site was completely covered in snow that was two feet deep. <br /> Roads <br /> The entrance road was covered in snow.as was the bridge across the river. The guard rail was in place. <br /> Signs and Markers <br /> The mine ID sign and support post were on the ground and covered in snow. Surface disturbance markers were <br /> up around the disturbed area. <br /> Facilities <br /> The entrance gate was open. The"no trespassing"sign was on the gate. The remaining concrete at the mine <br /> office was covered in snow. <br /> Hydrology <br /> The sediment pond was covered in snow.The snow level in the sediment pond was well below the vrimary <br /> discharge pipe elevation.The gated valve on the discharge pipe was closed.The sediment pond embankment <br /> appeared to be stable. The collection ditch leading into the sediment pond was covered in snow but appeared to <br /> have enough capacity. The protection berm between the facilities area and the river was in place.The hillside <br /> spring water treatment pond was covered in snow and ice.The treatment pond was discharging at about 10-15 <br /> gpm and the discharge was orange in color,which has been found to be in compliance. The hillside spring was <br /> flowing into the treatment pond via the ditch and culvert.No problems were noted with the two alluvial wells. <br /> Reclamation <br /> The reclaimed east side fan area.reclaimed west side portals area and the reclaimed portal road were covered in <br /> snow. There was some water vapor or steam coming from the cliff directly above the reclaimed portal area. <br /> Noxious Weeds <br /> Tamarisk can be found in the hillside spring area and in the hillside spring water treatment pond and should be <br /> eradicated appropriately. <br /> Records <br /> The required records were at the Bowie No. 2 Mine office.as documented on the attached records checklist. <br /> c:/word/bear3/insp0109 <br />
