III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator.Most of the loadout was covered in snow that was about 6 to 8 inches deep. <br /> Signs and Markers <br /> The required loadout information was on each of the three mine ID signs. The signs were located at the main <br /> entrance,east entrance and along the side road near the railroad tracks.Permit boundary markers were in place. <br /> Roads <br /> The paved haul road was in good condition and free of snow and ice.The guard rail was in place.The east side <br /> graveled road was covered in snow but was passable.The gate at the east entrance was open. The light use road <br /> along the railroad tracks was also covered in snow. <br /> Facilities <br /> The operator was repairing part of the screening structure so no processing of coal was taking place during the <br /> inspection.No railcars were being loaded and no coal haul trucks were being unloaded during the inspection. <br /> There was only a small volume of stockpiled coal on the facilities bench.There were no indications of fugitive <br /> dust going offsite or coal fines being tracked onto the highway. <br /> There were no problems at the loadout office, substation,material storage area,coal truck unloading structures, <br /> coal screening structures,railcar loading structures or the fuel facility. <br /> Hydrology <br /> The east side sediment pond was completely covered in snow.The gate on the primary discharge pipe was <br /> closed.The west side dugout sediment pond was also covered in snow.The culverts and ditches that lead to the <br /> east side sediment pond and the straw bales and silt fence along the railroad track small area exemption were <br /> covered in snow as well. <br /> Topsoil <br /> The east side topsoil stockpile and the west side topsoil stockpile were covered in snow. The stockpiles' <br /> containment and diversion ditches were also covered in snow.Topsoil signs were up on both topsoil stockpiles. <br /> Records <br /> The required records were located at the loadout office and were in compliance,as documented on the attached <br /> records checklist. <br /> c:/word/terror/insp0109 <br />
