Current Previous and Pending Coal Mining Permits Held by Seneca Coal Company and Principal
<br />Shareholders
<br />Seneca Coal Company currently holds three coal mining permits in the United States. Two of these
<br />permits, C-80-005 for Seneca II Mine and C-82-057 for Seneca II-W Mine were transferred from
<br />Peabody Coal Company to Seneca Coal Company on October 17, 1994. The third permit, C-94-082
<br />for Yoast Mine, was issued to Seneca Coal Company on August 7, 1995. Current, previous,. and
<br />pending mining permits obtained by Seneca Coal Company and its principal shareholders are listed in
<br />Appendix 3-5.
<br />Legal Owners of Record of the Surface, Coal, Oil, Gas, and Other Minerals
<br />The following lists the owners of record of the surface, coal, oil and gas, and other minerals within
<br />the permit area of the Yoast Mine. Exhibit 3-1 depicts the areas associated with these ownerships.
<br />Appendix 3-2 provides an alphabetical listing of the owners and their addresses. Appendix 3-3 lists
<br />the ownership by legal description as recorded at the Routt County Courthouse.
<br />Please note that minerals owners, other than coal, oil, and gas, are the same as the oil and gas owners.
<br />However, no other minerals are leased at this time.
