Dear Ms. Burgmaier:
We have completed our review of Seneca Coal Company's (Seneca)
Yoast Mine Permit Application Package (PAP). The PAP was reviewed
for the following:
Compliance with special lease stipulations and agency rectulations.
No compliance problems were identified with the special lease
stipulations.
(a) Cultural resource inventories are included and proper on-going
consultation documented.
!b) Paleontological resources are not addressed in the mine plan
specifically, however, the federal lease stipulation adequately
identifies measures to be taken in case of discovery of fossils
during operations. No conflicts between the lease and mine plan
were identified.
(c) No surface disturbance is proposed in the area identified on the
lease as Fragile Soils.
Analysis of lands unsuitable for surface mining and reclamation pursuant
to 43 CFR 3461.
Through our land use planning process, none of the lands contained in
the affected federal lease 000088199 have had unsuitability applied.
Unsuitability criteria were applied to the lands added to lease
0000114093 prior to lease modification. Pursuant to 43 CFR 3461.3-2 we
do not apply unsuitability criteria to leased lands. No unleased
Federal lands are proposed to be affected by mining within the mine
permit area.
Conflicts between post-mining land uses and existing BLM land management
plans and policies.
Seneca has addressed our concerns under this heading. No other
problems were identified.
