December 14, 2007 <br />Dennis Hallenbeck <br />36190 County Road 27 <br />Hayden, CO 81639-9621 <br />RE: Retention of Permanent Features/Structures <br />Dear Mr. Hallenbeck, <br />Seneca Coal Company (SCC) is in final stages of reclamation at the Yoast mine. SCC has applied for a Phase I <br />Reclamation bond release on a portion of the mined and reclaimed area. SCC will proceed with bond release <br />requests for the remainder of the area in the near future, including the following features listed below: <br />® Dragline Deadhead Route <br />This area is adjacent to County Road 27 and contains apullout/parking area along side the county road, a <br />boundary fence, a stock pond and pasture land. <br />The Routt County Road and Bridge redesigned and reconstructed County Road 27 in 2006. The <br />reconstruction of RCR 27 created a small area of disturbance adjacent to your stock pond. Therefore, as SCC <br />has discussed with you, we request that you sign the attached letter requesting that the area remain as it <br />• currently exists. <br />SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first <br />step is to obtain a letter from the landowner requesting that the feature/structure be left as permanent_ This step <br />is in accordance with the Colorado Mined Land Board Regulations for Coal Mining. <br />® Rule 2.05.5 (11(bl, the posimining land use descrrpiion shall be accompanied by a copy of the comments concearring the proposed <br />arse by the legal or equitable owner of rzcord of the surface of the praposed permit area and the State and localgnvernment agencies <br />lvhich would have to initiate, implement, apprr~ve, or authorize the proposed use of the Imrd following reclamation <br />If you have any questions, please contact Roy Karo at (970) 276-5217 or 846-3648, otherwise we request that you <br />sign one copy of the attached request letter and return it to Seneca Coal Company in the self addressed stamped <br />envelope.
