SCC has applied for a Phase I <br />Reclamation bond release on a portion of the mined and reclaimed area. SCC will proceed with bond release <br />requests for the remainder of the area in the near future, including the following features listed below: <br />• Fenced si~rub plots <br />There is a portion of a fenced shrub plot (0.6 acres) that extends into your property along the northern <br />boundary <br />® 1~3iscellaneous fences <br />These fences include boundary and grazing control fences. <br />• SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first <br />step is to obtain a letter from the landowner requesting that the feature/structure be left as permanent. This step <br />is in accordance with the Colorado Mined Land Board Regulations for Coal Mining: <br />® Rule 2.05.5(11(b), the postmining land use description .shall be accompanied by a rnpy of the comments concerning the proposed <br />use by the legal or equitable owner of record of the surface of the prr posed permit area and the State and localgovernmerrt agencies <br />which would have to initiate, implement, approve, or arsthori~e the prrposed use of the Jared following reclamation. <br />If you have any questions, please contact Roy Karo at (970) 276-5217 or 846-3648, otherwise we request that you <br />sign one copy of the attached request letter and return it to Seneca Coal Company in the self addressed stamped <br />envelope.
