(b) The level of water shall be sufficiently stable, and the configuration of the pond shall be adequate, to <br />support the intended use; <br />(c) Adequate safety and access to impounded water shall be provided for proposed water users; <br />(d) Water impoundments shall not result in the diminution of the quality or quantity of water available to water <br />right holders for agricultural, industrial, recreational, or domestic uses except in accordance with applicable <br />state law; <br />(e) The size of the impoundment shall be adequate for its intended purposes; <br />(f) The impoundment shall be suitable for the approved post-mining land use. <br />Detailed discussions and relevant information is presented in various sections of Tab 7, Hydrologic Description. <br />The following is a summary of the details contained in Tab 7. Permanent pond demonstrations are contained in <br />Appendix 20-1.2, Permanent Pond Demonstrations. <br />Stock Ponds <br />There is one (1) stock pond (ST-1) that will remain permanent following reclamation. The stock pond was <br />constructed in reclaimed area and is not primary sediment control structures. It has a storage capacity of less than <br />two-acre feet and an embankment no greater than five feet high measured from the invert of the spillway to the <br />upstream toe of the embankment. Given that the existing stock pond is relatively small in size and there are no <br />residential or commercial structures or mining operations immediately below the structure, it does not create a threat <br />to public health and safety or threaten significant environmental harm. This permanent stock pond will enhance the <br />approved post mine use. Permanent pond demonstration is contained in Appendix 20-1.2, Permanent Pond <br />Demonstrations. <br />Miscellaneous Boundary and Grazing Fences <br />There are a variety of fences that will be left as permanent within the permit boundary following reclamation. There <br />are fences delineating the boundaries between the various surface land owners and some areas of the reclaimed area <br />have fences to establish separate grazing pastures within the reclamation to promote revegetation to meet success <br />criteria for designated post mining land use. <br />• <br />TR-37 20-1.4 08/08 <br />
