• site at several critical occasions during the construction of this pond. The summary of the compaction <br />testing for the Pond 013 embankment is located in Addendum 13-20-E. <br />The purpose of my inspection and certification was to make sure proper construction of Sedimentation <br />Pond 013 and to satisfy the requirements of Rule 4.05. 91141 of the Colorado Mined Land Reclamation <br />Board. The material was placed in the embankment to meet or exceed the design specifications (see <br />Addendum 13-20-E for compaction informationl. This as-built report confirms the construction of this <br />structure meets or exceeds the Rules and Regulations of the Colorado Mined Land Reclamation Board. <br />The structure is stable, and displays no evidence or indications of slope instability. <br />To the best of my knowledge, based on my professional expertise, and to the extent possible, Pond <br />013 at the Yoast Mine was constructed in accordance with the prudent state-of-the-att methods for <br />earthen embankment construction. Further, the structure was constructed in compliance with the <br />approved design, to the extent possible, as specified in Attachment 13-12, Drainage and Sediment <br />Control Plan, of Seneca Coal Company's approved mine permit. <br />Conclusion <br />Sedimentation Pond 013 does meet or exceed the design and performance requirements of the <br />• Colorado Mined Land Reclamation Board. Seneca Coal Company will inspect the pond quarterly to <br />evaluate structural integrity, storage capacity conditions and remedial work requirements in <br />accordance with the approved mine permit. Therefore, pursuant to Rule 4.05. 91141, the above is the <br />Sedimentation Pond 013 as-built certification report. <br />~~ <br />TR-26 3 Revised 09/04 <br />
