B. ISSUES -RAISED THAT THE DIVISION BELIEVES ARE NOT WITHIN THE <br />JURISDICTION OF THE DIVISION OR BOARD <br />1. Traffic <br />Mr. Coleman's letter indicates that the traffic associated with the current mining operation is <br />excessive. <br />Division Response <br />County road traffic issues fall under the jurisdiction of the La Plata County and not the Division of <br />Reclamation, Mining, and Safety. <br />2. Noise <br />Mr. Coleman's letter indicates that the noise associated with the current mining operation is <br />excessive. <br />Division Response <br />Noise issues related to the operation fall under the jurisdiction of the La Plata County and not the <br />Division of Reclamation, Mining, and Safety. <br />3. Excessive Light <br />Mr. Coleman's letter indicates that the light associated with the current mining operation is <br />excessive. <br />Division Response <br />Lighting issues related to the operation fall under the jurisdiction of the La Plata County and not the <br />Division of Reclamation, Mining, and Safety. <br />III. DIVISION RECOMMENDATION <br />It is the Division's determination that the Applicant has fulfilled all of the minimum requirements for <br />approval of the proposed amendment to the AGRI-DLD Gravel Pit permit M-2000-030. Therefore the <br />Division recommends approval of the amendment. <br />2
