Dorado Place, Suite 210
Englewood, CO 80111
Re: Cotter Corporation - Schwartzwalder Mine, Jefferson County -
No. TR-09; Permit No. M-1977-300 i--
Dear Ms. Thurlkill:
Bill Ritter, Jr.
Governor
Harris D. Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
Technical Revision Approval, Revision
On December 14, 2007, the Division of Reclamation, Mining, & Safety (Division) approved the Technical Revision
application filed with the Division on December 7, 2007 that addresses the following:
Hydrologic Sealing of Steve Level Adits
The terms of the Technical Revision No. 9 approved by the Division are hereby incorporated into Permit No. M-1977-
300. All other conditions and requirements of Permit No. M-1977-300 remain in full force and effect.
Because hydrologic seals are already included in the approved Reclamation Plan on file, and the seals in TR09 represent
an optional upgrade that are a contingency in the event that the mine pool rises to a level that the hydrologic study
indicates is unlikely, DRMS has decided that no additional Financial Warranty is necessary at this time. However,
DRMS retains the option to impose additional Financial Warranty on the TR09 seals in the event that installation of the
seals is not completed within a reasonable time period.
The approval of TR 09 is contingent upon the receipt of one additional item. In accordance with Rule 1.8.1(2), the
Operator must provide the Division with an affidavit or receipt demonstrating that the amendment or technical revision
was placed with the County Clerk and Recorder. To date the Division has not received this.
If you have any questions, you may call me at (303) 866-3567.
Sincerely,
l
aA
David A.
