<br />Structural demolition activities at the east mine and the unit train loadout were completed <br />according to the approved schedule. <br />According to the approved reclamation schedule, backfilling and grading activities at the <br />east mine should now be in progress. However, only minor reclamation activities have <br />taken place at the east mine this year. Since Rule 4.14.1(1)(d) requires that the approved <br />timetable for backfilling and grading reclamation activities be a condition of the permit, <br />non completion of the backfilling and grading plan at the east mine by the end of the first <br />quarter of 2008 will be considered a violation of one of the conditions of the permit. <br />Section 2.07.6. Criteria for Review of Permit Applications for Permit Approval or Denial <br />8. As required in Section 2.07.6(1)(b), the Division will be conducting computer checks of <br />the Applicant Violator System (AVS) during the process of permit renewal. If any issues <br />surface, BRL will be informed. <br />Responses from Other Agencies <br />9. The Division received an adequacy letter, dated October 9, 2007, from the Colorado <br />Division of Water Resources concerning RN5.
