mine should now be in progress. However, only minor reclamation activities have taken place at <br />the east mine this year. Since Rule 4.14.1(1)(d) requires that the approved timetable for <br />backfilling and grading reclamation activities be a condition of the permit, non completion of the <br />backfilling and grading plan at the east mine by the end of the first quarter of 2008 will be <br />considered a violation of one of the conditions of the permit. <br />BRL noted the Division's comment. The Division understands that BRL is in the process of <br />securing bids from contractors to perform the reclamation work. <br />Section 2.07.6, Criteria for Review of Permit Applications for Permit Approval or Denial <br />8. As required in Section 2.07.6(1)(b), the Division will be conducting computer checks of the <br />Applicant Violator System (A VS) during the process ofpermit renewal. Ifany issues surface, BRL <br />will be informed. <br />On November 2, 2007, a computer check of the AV S showed that there were no outstanding <br />violations associated with the Bowie No. 1 Mine. The Division recommendation was to issue. <br />Additional AVS checks will be conducted prior to the proposed decision and prior to permit <br />issuance. <br />Responses from Other Agencies <br />9. The Division received an adequacy letter, dated October 9, 2007, from the Colorado Division of <br />Water Resources concerning RNS. As stated in the letter, the agency has no concerns with the <br />application.
