warranty for the Cresson Project as approved under Amendment No. 9. These additional funds
would more than offset any costs associated with blasting the approximate 8,100 linear feet of
highwall not to final design configuration.
In addition, worst case highwall blasting liability would be covered by excess financial warranty
amount until approximately 100 days prior to completion of Cresson Project (see Attachment #1,
page 1). CC&V Engineering Department assures that linear feet of highwall not to final design
configuration would be significantly reduced during the final year of the project as mining
activities would be occurring only in one mining area.
The documents submitted herein do not affect the financial warranty as approved under
Amendment No. 9, but is meant to demonstrate that there is more than adequate excess financial
warranty in place to cover even the worst-case highwall configuration.
If you have any questions or require further information, please contact me at your convenience
at (719) 689-4055.
Sincerely,
/ "Pt'W.
Timm Comer
Chief Environmental Coordinator
cc: Gary Goodrich, CC&V
Jeff Campbell, CC&V
Enclosed: Attachment #1, 2 pages
