<br />and confirm to the Division in writing that all threatened and endangered species and candidate <br />species and their habitats listed for Delta County have been discussed and evaluated. If not, a new <br />survey will need to be performed for this permit renewal using the current list of threatened and <br />endangered and candidate species for Delta County. I fa new T&E survey is performed, the <br />Division will forward it to the OSM and they may send it to the US Fish and Wildlife Service for a <br />Section 7 consultation. <br />The Division has no further concerns. In the submittal dated September 6, 2007, Minrec provided <br />copies of the Threatened & Endangered Inventory dated September 3, 2007, as well as a revised <br />table of contents page viii. In a letter dated September 12, 2007, the Division sent a copy of the <br />inventory report to the Office of Surface Mining (OSM) for its review. OSM decided that it was <br />necessary to confer with the U.S. Fish & Wildlife Service. A copy of the formal section 7 <br />consultation request from the OSM to the U.S. Fish & Wildlife Service was sent to BRL. <br />Attached is a copy of the December 19, 2007 Biological Opinion Memorandum in which the U.S. <br />Fish & Wildlife Service 7 found that no new actions or consultations are needed for RN-05. <br />Section 2.05.4, Reclamation Plan <br />5. The Division is in the process of reviewing the reclamation cost estimate. When the estimate is <br />completed, a copy will be forwarded to Minrec for its review. After Minrec's review, please inform <br />the Division in writing whether or not the Division's cost estimate is acceptable. <br />The Division has no further concerns. The Division provided a copy of the reclamation cost <br />estimate for Minrec's review in a letter dated September 21, 2007. In a letter dated September 27, <br />2007, Minrec accepted the Division's reclamation cost estimate of $42,065 for RN-5. Currently, <br />the Division holds a bond of $48,000.00 for the Blue Ribbon Mine. <br />Section 2.07.6. Criteria for Review of Permit Applications for Permit Approval or Denial <br />As required in Section 2.07.6(1)(b), the Division will conduct a computer check of the Applicant <br />Violator System (A VS) for the adequacy review. When finished, the Division will inform Minrec of <br />the results. The Division will conduct additional AVS checks before the permit renewal is final. <br />The Division conducted an AVS check during the adequacy review and the system <br />recommendation was to issue. The Division will conduct additional AVS checks prior to the <br />proposed decision and prior to permit issuance. <br />If you have any questions, please call me. <br />Sincerely, <br />tn h J.
