-2- <br />Rio Blanco County has wetland protection statutes that regulate any activity within <br />wetlands and is requiring that you develop a county-level Environmental Assessment (EA) prior <br />to permitting this proposed project. County permitting may require compensatory mitigation on <br />par with the compensatory mitigation that the Corps of Engineers would require. Therefore, we <br />recommend that you apply for a Department of the Army standard permit in order to ensure that <br />you remain in compliance with all applicable laws and regulations, and avoid the risk of any <br />unauthorized discharge of dredged or fill material in waters of the United States. <br />Please refer to identification number SPK-2008-1038 in any correspondence concerning <br />this project.
