The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of
Terror Creek LLC's submittal of Minor Revision No. 25 for the Terror Creek Loadout. The following are
the Division's adequacy review questions:
1) On Permit Page 2.03-5 (Rev. Dec. 2008), under 2(a), the EIN for Terror Creek LLC is wrong.
The permit page has Terror Creek Company's EIN, please update to show the EIN for Terror
Creek LLC.
2) On Permit Page 2.03-8 (Rev. Dec. 2008) the EIN for Oxbow Mining, LLC is wrong in both
places, please update to show correct EIN.
3) Please provide documentation that Terror Creek LLC is registered with the State of Colorado's
Office of the Secretary of State.

4) On Permit Page 2.03-6 (Rev. Dec. 2008) you have listed Edward L. Merwin, Vice President, Date
Elected 7/14/2003, but on the Directors/Officers Report dated 10/21/2008, Edward L. Merwin is
not listed at all. Is he an officer of this company? If not then please update the Permit Page.
5) On Permit Page 2.03-6 (Rev. Dec. 2008) you have listed Paul S. Fritzler, Vice President, Date
Elected 7/14/2003, but on the Directors/Officers Report dated 10/21/2008, Paul S. Fritzler has an
End Date of 5/5/2008. Please update the permit page.
6) On the Directors/Officers Report dated 10/21/2008, Tony Grimes, Vice President, Date Elected
8/1/2008, is not on the Permit Page. Please update the permit page to reflect Tony Grimes as
Vice President.
