III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 29 December 2008. The weather was cloudy on 12/29 <br /> during the on-the-ground inspection of the site. There was a substantial amount of snow cover <br /> throughout the mine site and access to the entire mine site was limited. A portion of the inspection <br /> was conducted from County Road 29 to the west of the mine site. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south and the North Road entering the mine area from the north. All mine I.D. signs appeared to be in <br /> compliance with no problems noted. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road were covered with a substantial amount of snowfall and access was <br /> either limited or inaccessible. Portions of the North Road the Old Tipple Road, Lower Moffat Road, <br /> Center Ridge Pond Road, West Ridge Pond Road, and West Ridge Road were inspected from <br /> County Road 29 and no problems were noted. <br /> Hydrologic Balance <br /> All sediment ponds appeared to contain frozen water with substantial ice and snow cover evident. All <br /> embankments appeared to be stable with no visible signs of erosion or damage. The four Moffat <br /> down drains were covered in snow but appeared stable with no evident signs of damage. <br /> The "string-of-pearls" permanent drainage channel contained was completely covered with snow. The <br /> area appeared to be stable with no signs of damage. <br /> Support Facilities <br /> Due to the substantial amount of snow cover, the permanent buildings at the mine site were <br /> inaccessible. These buildings were observed from County Road 29 and no problems were noted. <br /> The permanent office located on Old Tipple Road was observed off of state highway 131 and <br /> appeared stable with no problems noted. All three permanent sediment ponds and the check dams <br /> appeared to be in compliance. <br /> Revegetation <br /> Due to the high amount of snow cover, any revegetation progress was undetermined during this <br /> inspection. <br /> Slides and Damage <br /> There was no evidence of slides or damage during this inspection <br /> Reclamation Success <br /> Although snow cover made visibility of reclamation success difficult, there did not appear to be any <br /> problems with reclamation at the mine site during this inspection. <br />
