8. No activities shall be allowed within'/ mile of an active flammulated owl nest from March <br />1 to July 31. <br />9. No activities shall be allowed within one mile of an active bald eagle or peregrine falcon <br />nest from February 1 to July 31 if they would cause nesting failure or abandonment. <br />(LRMP III-33) <br />10. No surface occupancy beyond historic levels within'/ mile radius of active golden eagle <br />nests. (CDOW 2008). Seasonal restriction to human encroachment within %2 mile <br />radius of active nests from December 15 through July 15. (CDOW 2008). <br />11. All road use and maintenance on the Forest Service system roads must be performed <br />according to Bowie's existing Forest Service Road Use Permit. <br />12. The USFS officer ma_y_require surfacing of temporary roads where justified by conditions <br />or traffic volumes. <br />13. All fuel and hazardous material storage will be at lease 100 ft from any water resource <br />and will be double contained. <br />14. During construction operations, the Hubbard Creek Road will be closed to public <br />motorized access. This road will be signed and blocked as directed by the Forest <br />Service. <br />15. Bowie is responsible for using appropriate MUTCD traffic control devices when any <br />heavy equipment is moved on Forest Roads. Bowie will post warning signs, at locations <br />designated by the USFS, to warn the public of increased traffic on roads resulting from <br />project activities. Additional security and public safety measures may be considered and <br />approved or directed by the District Ranger. <br />16. Disposal of sewage and trash will be at an authorized disposal site off the Forest. <br />Portable toilets must be provided for personnel working on the drill sites. <br />17. The Operator will comply with any fire restrictions in effect at the time of proposed <br />operations. The Forest Service reserves the right to suspend operations during periods <br />of high fire potential. Forest Service will provide the operator as much advance notice of <br />anticipated closure orders as possible. <br />18. The Operator will have ability to contact emergency services, including Montrose <br />Interagency Fire Dispatch at all times. Fire extinguishers, ABC grade, at least 5 lbs. or <br />greater, will be on or near each internal combustion engine. <br />19. All gasoline, diesel, and steam-powered equipment must be equipped with effective <br />spark arresters or mufflers. Spark arresters must meet Forest Service specifications <br />discussed in the "General Purpose and Locomotive (GP/L) Spark Arrester Guide, <br />Volume 1, April, 1988"; and "Multi-position Small Engine (MSE) Spark Arrester Guide, <br />April, 1989". In addition, all electrical equipment must be properly insulated to prevent <br />sparks. <br />20. Bowie will be held responsible for damage and suppression costs for fires started as a <br />result of operations to the extent permitted by state and federal law.
