The construction of this project is complete, with <br />the exception of the pigging system. Red-line drawings from the contractor have been submitted to the design <br />engineer for completion of As-Built Drawings. <br />Completion of the pigging system requires a valve to be installed that is not scheduled for delivery until late <br />January, 2009. The final As-Built Drawings and Close-Out Report will be submitted to the DRMS along with a <br />final Environmental Protection Facility Engineer's Certification upon completion of the pigging system installation. <br />The final EPF Certification package is anticipated complete for submittal to the DRMS in February. <br />As this was a replacement of a pipeline that must be used on a continuous basis to maintain compliance with our <br />NPDES permit, the switch over to the new pipeline occurred December 5, 2008. The new pipeline has been in <br />continuous use since that time. Climax is requesting interim DRMS approval for the use of this pipeline until the <br />final EPF Engineer's Certification package can be completed and submitted for final DRMS approval. <br />If you have any further questions regarding this project, please contact me at (719) 486-7561. <br />Sincerely, <br />Tavis D.
