Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 54, Mine Water Discharge, Second Adequacy Review Letter <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) responses, dated December 15, 2008, to the Division's initial adequacy review <br />letter dated July 23, 2008 for Technical Revision No. 54 (TR-54). The following is the status of the Division's <br />questions and comments. Only item number 9 remains to be resolved. <br />Section 2.05.3, Operation Plan - Permit Area <br />1. Please depict the proposed route, buried and above ground, and the outfall location of the mine <br />water discharge pipe on Maps Nos. 15-1 and 21-1. <br />The Division has no further concerns. In the submittal dated December 15, 2008, BRL supplied a <br />new Map 41 that shows the complete route of the pipeline. <br />Section 2.05.6, Mitigation of the Impacts of Mining Operations <br />2. Please ensure that there is erosion protection at the mine water discharge pipe outlet. If riprap is <br />to be used, please designate this on Maps Nos. 15-1 and 21-1. <br />The Division has no further concerns. In the December 15, 2008 submittal, BRL stated that the <br />vegetation in the ditch will control erosion. <br />3. Please demonstrate that the State Highway 133 ditch and culvert which will receive the mine <br />water discharge can handle the increase inflow proposed in TR-54. Also, please provide <br />documentation that CDOT approves of the proposed increase inflow in the State Highway 133 <br />ditch and culvert. <br />The Division has no further concerns. BRL provided a copy of the CDOT Utility Permit that <br />allows the mine to use the irrigation system, including the highway culvert for mine water <br />discharge. BRL also stated that the irrigation ditch and culvert have sufficient capacity. <br />4. Please add a discussion to the permit application text that describes whether or not there are any <br />lands, river banks, structures, alluvial valley floors or prime farm land on either side of State <br />Highway 133 that potentially may be adversely affected by the mine water discharge quantity or <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
