(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1980-178 <br />INSPECTION DATE: 12/9/2008 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS THM <br />This inspection was conducted as part of the normal monitoring program established by the Colorado Division of <br />Reclamation, Mining and Safety. The Moores Pit is located 10.0 miles east of east of Gateway, Colorado off of <br />Highway 141, in Mesa County. The site is a 110c operation that consists of 9.96 acres. Jean Moores, Leon Moores <br />and Craig Moores of Moores Mining, Ranching and Sawmill were all present during the inspection. <br />The purpose of this inspection was to observe the current conditions at the site to assess reclamation cost <br />requirements in order to complete the process for succession of operator from Moores Mining, Ranching and <br />Sawmill to Moores Mining, LLC. <br />The mine identification sign and affected area boundary markers are in place and incompliance with rule 3.1.12. <br />No significant erosional features were noted on the affected areas of the site <br />No significant infestations of noxious or other problematic weeds were noted on site during the inspection. <br />The current approved mine plan states that the mining depth is expected to reach 15 feet and that the slopes will be <br />excavated to 3H:1 V as the excavation of material reaches the boundaries. Conditions observed during the inspection <br />were not consistent with the approved mine plan. The working face of the pit is approximately 40 feet high with <br />some benching observed toward the south end of the highwall. The conditions observed during the inspection were <br />not in compliance with the approved mine plan. This is listed as a problem on the last page of this report with <br />corrective actions that must be taken by the correction date specified. The depth and steepness of the slopes were <br />listed as a problem in the February 2002 inspection report. <br />In an effort to ensure the financial warranty remains adequate to reclaim this site per the requirements of the <br />approved reclamation plan, DRMS has updated the reclamation cost estimate (copy enclosed). Therefore, <br />pursuant to section 34-32.5-117(4) of the Colorado Land Reclamation Act, adequate financial warranty must <br />be submitted to the Division within 60 days of the mailing of this report.
