Findings <br />The Board of County Commissioner hereby makes the following findings with <br />regard to SUP application # 08-011: <br />A. that the applicant, Mr. Joseph Gagliano, in his capacity as consultant to <br />Robinson Sons, Inc., is owner of record of the land proposed for Special Use <br />Permit to establish and operate a gravel extraction operation; and <br />B. that the applicant has met the submission requirements under the Las Animas <br />County Land Use Code applicable to SUP application# 08-011. <br />Determination <br />The Board. of County Commissioners hereby approves Special Use Permit <br />application #08-011, by Mr. Joseph Gagliano, Consultant with the firm of LJ <br />Development; Inc., representing Robinson Sons, Inc., authorizing the <br />establishment and operation of a gravel extraction operation on property owned <br />by Robinson Sons, Inc., located in the S 1/2 Section 26, T33S, R67W, of the 6th <br />P.M., and more fully described in documents. submitted with said application, <br />subject to the following conditions: <br />1. that the applicant shall only extract gravel from the 56.65 acres, as shown on <br />-- the survey map prepared by Mr. Joseph Gagiliano, dated March 12, 2008, and <br />subsequently revised on September 2, 2008, (the Revised Map); and <br />2. that the applicant shall extract gravel from the site in phases as shown in the <br />Revised Map; and <br />3. that the applicant shall develop, submit and abide by a Dust Mitigation Plan <br />for control of dust resulting from excavation/crushing operation and the <br />movement of vehicles along the haul road for transportation of said gravel <br />materials; and <br />4. that the applicant shall apply magnesium chloride (or other suitable dust <br />suppression or chemical acceptable to Las Animas County) as a means of dust <br />control at all times that crushing/screening operation of gravel materials shall <br />be in process and shall apply- said chemical in sufficient quantities upon <br />stockpiled gravel pits so as to prevent dust from blowing from said stockpiled <br />gravel materials; and <br />5. that the applicant shall apply a dust control chemical in sufficient quantities at <br />least one half hour in advance of the start of hauling operations on any day of <br />operations to mitigate against blowing dust from vehicle movements on the <br />private haul road utilized for ingress/egress to the gravel extraction site; and
